By using Trauma & Empathy, you acknowledge that sharing sensitive information always carries inherent risks, and you accept responsibility for the content you choose to share on our platform.

We do not intentionally collect personal data that can identify you. Trauma & Empathy is designed to be fully anonymous. However, we may collect:

  • Email addresses (if provided for account recovery or notifications).
  • Any information you voluntarily include in your posts or profile.

Important: While we provide randomly generated usernames and icons, any personal details you choose to include in your posts could potentially identify you. We strongly advise against sharing identifying information in your content.

We recommend using an anonymous email address that does not contain your name and is not used elsewhere online to prevent potential identification.

3. How We Use Your Information

We use collected data to:

  • Improve platform functionality and user experience.
  • Ensure compliance with platform rules and our Terms of Use.
  • Analyze aggregated, non-identifiable usage trends.
  • Moderate content to maintain community standards.
  • Comply with legal obligations, including mandatory reporting requirements.

In exceptional circumstances, we may review specific content if required by law or to investigate potential violations of our Terms of Use.

6. Photo Privacy and Data Management

We handle your personal photos with the utmost care and attention to privacy. Our photo privacy practices include:

6.1 How We Store and Process Photos

All photos uploaded to our platform are stored securely on encrypted servers. We implement industry-standard security measures to protect your photos from unauthorized access or breaches. Photos are processed with metadata removal to eliminate any embedded location or device information that could potentially identify you.

When you upload photos, we may compress them to optimize storage and loading speeds. We do not alter the visual content of your photos beyond compression, except where required to enforce our Terms of Use (such as cropping to remove other individuals).

We use secure third-party cloud storage providers to host photo content. These providers are bound by strict data protection agreements and do not have rights to use your photos for any purpose beyond storage and delivery.

6.2 Photo Retention and Deletion

Photos remain stored on our platform until:

  • You explicitly delete them
  • You delete your account
  • We remove them due to Terms of Use violations

When you delete photos or your account, we remove all photo files from active servers within 30 days. Backup systems may retain copies for up to 90 days for disaster recovery purposes, after which they are permanently deleted.

6.3 Photo Access Controls and Visibility

Photos you upload are visible only to other platform users according to your privacy settings. By default, photos are visible to the same audience as the related memory post. We do not make your photos visible to search engines or non-users of the platform.

You can control the visibility of your photos through:

  • Privacy settings that determine who can view your content
  • The ability to delete any photo at any time
  • Options to make specific memories (and associated photos) private

Our moderators review photos to ensure compliance with our Terms of Use. This review is conducted according to strict internal privacy protocols, and staff members are bound by confidentiality agreements. Moderator access to photos is logged and monitored.

6.4 Security Measures for Photos

All photos are transmitted using secure, encrypted connections (HTTPS/TLS) and stored in encrypted format on our servers. We do not use facial recognition technology on any uploaded photos. We do not create biometric profiles, identify individuals in photos, or use any automated systems to analyze facial features.

We automatically strip metadata (including location data, device information, and timestamps) from uploaded photos to further protect your privacy and prevent inadvertent sharing of potentially identifying information.

In the unlikely event of a data breach affecting your photos, we will notify you promptly in accordance with applicable data protection laws, providing information about the breach and steps we are taking to mitigate any potential harm.

6.5 Your Rights Regarding Photos

You can delete any photo you've uploaded at any time. To delete a photo, navigate to the memory containing the photo and select the delete option. Deletion is effective immediately for users, though complete removal from our systems may take up to 30 days.

You can request a copy of all photos you've uploaded to our platform as part of a data export request. To make this request, please contact our support team.

If you believe a photo was uploaded without proper permission or violates your rights, you can submit a removal request through our support system. We will review these requests promptly and take appropriate action.

6.6 Photo Data Use Limitations

We do not use your photos for marketing or promotional purposes under any circumstances. We do not share your photos with third parties except:

  • Where required by law
  • With our service providers who need access to provide platform functionality (such as storage providers)
  • As explicitly permitted by you

We do not analyze photo content for commercial purposes, advertising targeting, or to build user profiles beyond what is necessary to enforce our Terms of Use. We do not license, sell, or otherwise distribute your photos to third parties. Your photos remain your property, and we only maintain the limited license specified in our Terms of Use to display them on our platform.

6.7 Legal Compliance for Photo Data

While our platform is only for users 18 and older, we understand that users upload childhood photos of themselves. We handle these photos with special care and in compliance with applicable laws protecting children's privacy and image rights.

In the event we receive a legal request (such as a court order or subpoena) for access to photos, we will:

  • Evaluate the validity and legality of the request
  • Notify you when permitted by law
  • Provide only the minimum required information
  • Challenge overly broad requests when appropriate

If your photo data is transferred across international borders, we ensure such transfers comply with applicable data protection laws, including implementing appropriate safeguards for international data transfers.

6.8 Photo Privacy and Anonymity Considerations

Uploading any photo significantly reduces the level of anonymity you may otherwise have on the platform. While childhood photos can be powerful aids in telling your story, they may also reveal more than you intend. People who know you may recognize you from childhood photos, and advancing AI technologies may potentially connect these images to your identity. We encourage you to make thoughtful, informed decisions regarding your expectations of privacy and anonymity when sharing photos on the platform.

7. Content Ownership and Rights

7.1 Your Ownership of Content

You retain ownership of all content you submit, post, or display on or through Trauma & Empathy, including any text, photos, graphics, or other materials ("User Content"). Nothing in these terms transfers ownership of your User Content to us.

7.2 License to Trauma & Empathy

When you submit, post, or display User Content on or through our platform, you grant Trauma & Empathy a non-exclusive, royalty-free, worldwide, transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media or distribution methods now known or later developed. This license is limited to the purpose of operating, developing, providing, and improving our Services and researching and developing new ones.

This license authorizes us to make your User Content available to the rest of the world and to let others do the same according to your privacy settings. You agree that this license includes the right for us to provide, promote, and improve the Services and to make User Content submitted to or through the Services available to other companies, organizations or individuals for the syndication, broadcast, distribution, promotion, or publication of such User Content, subject to our terms and conditions for such User Content use.

7.3 Duration of License

This license exists for as long as you maintain your User Content on our platform and will terminate when you delete such content, except that: (a) content you delete may persist in backup copies for a reasonable period of time; and (b) content you shared with others may continue to be accessible until they delete it.

7.4 Your Responsibilities

You represent and warrant that: (i) you own the User Content posted by you or have the right to grant the rights and licenses described in these terms; (ii) the posting and use of your User Content does not violate, misappropriate or infringe on the rights of any third party, including, without limitation, privacy rights, publicity rights, copyrights, trademark and/or other intellectual property rights; and (iii) you agree to pay for all royalties, fees, and any other monies owed by reason of User Content you post.

7.5 Our Rights

We reserve the right to remove any User Content for any reason without prior notice. We may access, preserve and disclose your account information and User Content if required to do so by law or in a good faith belief that such access, preservation or disclosure is reasonably necessary to: (i) comply with legal process; (ii) enforce our Terms of Use; (iii) respond to claims that any User Content violates the rights of third parties; (iv) respond to your requests for customer service; or (v) protect the rights, property or personal safety of the Company, its users and the public.

7.6 Content Removal and Account Termination

You can remove your User Content by specifically deleting it. However, in certain instances, some of your User Content (such as posts or comments you make) may not be completely removed and copies of your User Content may continue to exist on the Service. We are not responsible or liable for the removal or deletion of (or the failure to remove or delete) any of your User Content.

In the event of account termination, all licenses granted by you herein shall automatically terminate, but all other provisions of the Terms will survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Data Sharing and Third-Party Services

We currently do not sell, rent, or license user data to third parties. However, we:

  • May use third-party service providers to help operate our platform (such as hosting providers, analytics services, and security tools)
  • May share anonymized, aggregated data with these service providers
  • Will comply with legal requirements, including court orders and subpoenas

Future Data Sharing: We reserve the right to share or license anonymized, non-personally identifiable data in the future. This could include aggregated statistics, anonymized post content, or pattern analyses derived from platform usage.

If we change our data sharing practices, we will provide notice through an updated Privacy Policy at least 30 days before implementation.

We will never knowingly share information in a way that could reasonably identify individual users or connect their anonymous accounts to real identities.

9. Mandatory Reporting

In compliance with applicable laws, we may be required to report certain content to authorities, including but not limited to:

  • Evidence of ongoing child abuse or exploitation
  • Credible threats of harm to self or others
  • Specific criminal activities as required by law

In such cases, we may be obligated to provide available information to appropriate authorities, even if this compromises anonymity.

10. Data Retention

We retain user data for as long as necessary to provide our services and comply with legal obligations. Specifically:

  • Account information is retained until account deletion
  • Posts remain on the platform until deleted by the user or removed for policy violations
  • Usage logs and analytics data may be retained for up to 24 months

Even after deletion, residual copies may remain in our backups for a limited time before being automatically purged.

11. Your Rights

You have the right to:

  • Delete your account and associated content
  • Edit or remove individual posts you've made
  • Adjust privacy settings within the platform
  • Opt out of non-essential communications
  • Request information about data we hold related to your account

To exercise these rights, use the relevant features within the platform or contact us directly.

Please note that due to the anonymous nature of our platform, we may require verification of account ownership to process certain requests.

12. Children's Privacy

Trauma & Empathy is only for users 18 years of age or older. We do not knowingly collect information from individuals under 18. If we learn that we have collected information from a person under 18, we will delete that information promptly.

13. Changes to This Policy

We may update this Privacy Policy from time to time. Significant changes will be reflected with an updated "Last Updated" date, and we may provide additional notice for material changes.

Your continued use of the platform after such changes constitutes acceptance of the updated policy. We encourage users to periodically review this Privacy Policy.

14. International Data Transfers

Your Personal Information may be transferred to, and maintained on, computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you're located outside the United States and choose to provide your Personal Information to us, we may transfer your Personal Information to the United States and process it there.

When we transfer your data across international borders, we implement appropriate safeguards in accordance with applicable data protection laws to ensure that your data receives an adequate level of protection. By using our Services, you consent to the transfer of information to countries outside your country of residence, including the United States, which may have different data protection rules than those of your country.

We may contract with third-party service providers to assist us in better understanding our site visitors and their usage patterns. These service providers are prohibited from using the information collected on our behalf except to help us conduct and improve our platform.

16. Do Not Track

We use cookies as described in Section 5 of this Privacy Policy. We do not use cookies to collect personally identifiable information or track users' online activities over time and across different websites. Some web browsers may transmit "Do Not Track" signals to websites with which the browser communicates, telling the site not to track the user. Because of differences in how web browsers interpret this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they are even aware of them.

17. Identity Verification for Data Requests

When you submit a request regarding your Personal Information (such as a request to access, correct, or delete your data), we may require additional information to verify your identity before processing your request. This is a security measure to ensure that Personal Information is not disclosed to any person who has no right to receive it.

The information we request for verification may include, but is not limited to, confirmation of the email address associated with your account or other account identifiers. We make good faith efforts to provide you with access to your Personal Information following your request, but we reserve the right to deny access where we cannot adequately verify your identity.

Where permitted by local law, we may reject requests that are unreasonable, excessive, or would require disproportionate technical effort.

18. Beta Features and Testing

We sometimes release beta versions of our platform features and services, which are further refined before the release of the final version. Because these features and services are still in a test phase, we may not always catch unintended privacy issues, despite our efforts to do so.

If you participate in testing beta features, you acknowledge that:

  • The feature may not operate as intended or contain bugs
  • Privacy protections may not function completely as designed
  • We welcome your feedback on any privacy concerns you encounter

Your participation in beta testing is voluntary, and you can discontinue use of beta features at any time.

Due to the complex and constantly changing nature of our technology and business, and the inherent security risks of using the Internet, we do not guarantee error-free performance under this Privacy Policy.

TO THE EXTENT PERMISSIBLE UNDER LAW, TRAUMA & EMPATHY AND DR.OOGLE INC. SHALL NOT BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RELATING TO THIS PRIVACY POLICY.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation may not apply to you.
